Regulations of the website and online store www.drzewozycia.net

§1 General Provisions

1. These regulations regulate the rules of using the Online Store at www.drzewozycia.net.

2. The online store, operating at www.drzewozycia.net (hereinafter referred to as: the online store www.drzewozycia.net, is run by Magdalena Zapalska, Sengera Cichego 22/1, 02-790 Warsaw, Poland, NIP 9512034254. Contact details of the entrepreneur, enabling the Buyer to contact the Seller:

3. Regulations of the online store www.drzewozycia.net are continuously placed on the website www.drzewozycia.net in a way that allows customers to obtain, reproduce and record its content. The Regulations are also made available to customers before concluding the contract.

 

 

§ 2 Definitions

The terms used in these regulations mean:

1. Consumer - it is a natural person within the meaning of Art. 221 of the Civil Code,

Entrepreneur with the rights of a consumer - it is a natural person concluding a contract directly related to its business activity, if the content of this contract shows that it does not have a professional character for that person, resulting in particular from the subject of its business activity, made available on on the basis of the provisions on the Central Register and Information on Economic Activity,

Entrepreneur - means a natural person, a legal person or an organizational unit that is not a legal person, to which the law grants legal capacity, conducting business or professional activity on its own behalf and performing a legal transaction directly related to its business or professional activity,

4. Service Provider / Seller - Magdalena Zapalska, ul. Sengera Cichego 22/1, 02-790 Warsaw, Poland. , NIP 9512034254.

  • Online store - an online store run at www.drzewozycia.net by Magdalena Zapalska. Civil Code - the Act of April 23, 1964. (Journal of Laws 2020.1740),

  • Goods and Services - all services provided and goods being the subject of the sales contract between the seller and the buyer,

  • Regulations - these regulations for the provision of electronic services within the meaning of art. 8 of the Act on the provision of electronic services of July 18, 2002 (Journal of Laws 2020.344),

  • Customer / Buyer - a natural person, legal person or organizational unit that is not a legal person, the specific provisions of which grant legal capacity, which places or plans to place an Order in the Online Store using electronic means, including a Consumer, Entrepreneur with consumer rights and Entrepreneur,

  • Order - Customer's declaration of intent, in which the Customer accepts the Seller's sales offer, which includes, in particular, the price, type, quantity of Goods or Services under the sales agreement via the online store.

  • Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws 2020.287).

 

 

§ 3 Rules for using the online store

  1. The prices of all goods and services offered by the Store are gross prices (including VAT) and are expressed in the Polish zloty . 
  2. The prices displayed on the website of the store www.drzewozycia.net, as well as descriptions of goods and services, constitute only commercial information and not an offer within the meaning of the Civil Code. They become binding - for the purposes of concluding a specific contract - only upon confirmation of the order being accepted by the Seller.

  3. The Seller uses in the online store www.drzewozycia.net, rebate codes authorizing the purchase of goods with a discount on the coupon. Discount codes cannot be converted into a cash equivalent.

  • To place an order in the online store www.drzewozycia.net, you must accept these Regulations.

  • To successfully place an order in the online store www.drzewozycia.net, it is necessary to have a device with Internet access that allows you to browse websites, as well as a keyboard or other device that allows you to correctly fill in electronic forms. It is recommended to use the latest versions of web browsers: Firefox, Chrome, Internet Explorer, Microsoft Edge, Opera, Safari for OS X, etc.

  • The Store's website is prepared to be displayed on both desktop computers and mobile devices.

  • The website of the online store www.drzewozycia.net has an SSL certificate - a secure protocol for encryption of communication.

 

 

§ 4 Conditions for concluding a sales contract

1. Orders in the online store www.drzewozycia.net, can be made by filling in the appropriate forms available on the Order Summary page . 

2. When placing an order, the customer is obliged to provide correct personal data: name and surname, address, e-mail address and mobile phone.

3. After receiving the order, the Seller confirms its receipt and at the same time informs about the acceptance of the Order for execution. The order is confirmed by sending the appropriate e-mail message to the Customer by the Seller to the address provided in the order form. Upon confirmation of the order acceptance by the Seller, the contract is considered concluded.

4. The content of the sales contract is made available and consolidated by making these Regulations available on the Online Store website, sending relevant information to the Customer's e-mail address provided when placing the order, referred to in §4 point 4.2.

5. Placing Orders in the online store www.drzewozycia.net is possible 24 hours a day, all days of the year.

 

 

§ 5 Payment method and payment date

1. In the shop www.drzewozycia.net, you can pay in one of the following ways:

  • transfer to the Seller's bank account,

  • payment via PayPal,

  • payment via the Stripe service.

2. After placing the order, the Customer receives by e-mail (e-mail) a bank account number to which the correct amount should be transferred when choosing a payment by traditional transfer. Once the payment is credited to the bank account of the shop www.drzewozycia.net, the order is transferred for processing.

3. The online store www.drzewozycia.net allows you to pay the amount due via the following external electronic payment services, such as:

  • Paypal (card payment and payment using a PayPal account if the customer has his own account)

  • Stripe (card payment)

4. The customer is obliged to make the payment using one of the above-mentioned methods within 7 calendar days from the date of the sale contract.

 

 

§ 6 Delivery

  1. The ordered goods are delivered  on the territory of the Republic of Poland and Europe and takes place at the address indicated by the Customer in the order form.
  2. In the case of orders outside Europe, the customer is obliged to write an e-mail to the following address: magdalena@drzewozycia.net for individual pricing. 

  3. The time of shipment of goods is marked on the website of the Online Store www.drzewozycia.net , is from 48 to 72 hours. The seller will make every effort to ensure that the delivery of the goods takes place  within the time specified in the product card in the online store. If it is not possible to deliver the goods within the above-mentioned time, the Buyer will be informed immediately.

  4. The delivery of the ordered Goods takes place via:

  • UPS

  • GLS

  • InPost courier

  • DPD courier

  • Parcel in RUCH

  • Polish Post

  • InPost Parcel Lockers

  • via email (audio, video, e-books)

5. When the goods are handed over to the courier, the Buyer is notified of this fact by sending an e-mail to the address provided in the order.

6. The costs of delivering the Goods, which, in addition to the price for the Goods, are borne by the Customer, are provided on the Store's website when placing the Order.

7. Upon receipt of the goods, the Customer is obliged to confirm its receipt. From now on, the goods become the property of the customer.

 

 

§ 7 Withdrawal from the contract

  1. The buyer who is a consumer or entrepreneur with the rights of a consumer, who has concluded a distance or off-premises contract, has the right to withdraw from the concluded sales contract within 14 days from the date of delivery of the goods delivered to him to the address provided by the customer when placing the order without giving any reason.
  2. Virtual download products are non-refundable.

  3. In the event of exercising the right referred to in point 1, the Buyer should inform the Seller about it by submitting a declaration of withdrawal on the form provided to him by the Seller, which may be sent by post to the following address: Sengera Cichego 22/1, 02-790 Warsaw; he can also do it electronically using the electronic withdrawal form sent to the seller's e-mail address magdalena@drzewozycia.net. To meet the deadline, it is enough to send a statement before its expiry. The declaration of withdrawal submitted after the deadline referred to in §7 point 7.1 has no legal effect.

  4. The declaration of withdrawal form (Appendix No. 1 to these Regulations) is provided to the Buyer in paper form (in the documentation attached to the shipment) and in electronic form (in the attachment to electronic correspondence confirming the acceptance of the order for execution).

  5. If the Consumer or the Entrepreneur submits a declaration of withdrawal by electronic means via the electronic withdrawal form, the Seller shall immediately send confirmation of receipt of the declaration of withdrawal (on a durable data carrier within the meaning of Article 2 point 4 of the Act of 30.5. 2014 - on consumer rights.

  6. The cost of returning the goods, except for the situation referred to in art. 33 (i.e. in the event of additional costs resulting from the method of delivery chosen by the Consumer or the Entrepreneur as a consumer, other than the cheapest standard delivery method available in the Online Store) and art. 34 sec. 2 of the Act of 30/05/2014 - on consumer rights, is borne by the Seller.

  7. The buyer is obliged to properly secure the returned goods so as to prevent their damage in transport (direct cost of returning the item - in accordance with Article 34 (2) of the Act of 30/05/2014 - on consumer rights (i.e. Journal of Laws of 2017. item 683). The consumer or the Entrepreneur with the rights of the consumer bears the direct costs of returning the goods.

  8. The cost of shipping physical products is the responsibility of the customer returning the product.

  9. The consumer or entrepreneur with consumer rights is obliged to return the items immediately, but not later than within 14 days from the date on which he withdrew from the contract. The seller may stipulate that in the event of withdrawal from the contract, the item to be returned will be collected by him or a person authorized by him.

  10. If the delivered goods are incomplete or have traces of use that go beyond the ordinary management of the item, the Seller reserves the right to refuse to accept the shipment or to reduce the amount returned by the equivalent of the damaged goods.

  11. In the event of withdrawal from the contract, all payments made by the Buyer, excluding shipping costs, will be transferred to the Buyer's bank account immediately, but not later than within 14 days from the date of receipt by the Seller of the Buyer's statement on withdrawal from the contract.

  12. The Seller declares that the reimbursement referred to in § 7 point 7.9 of the Regulations will be made using the same method of payment as used by the Buyer. The Seller, in agreement with the Buyer, may agree on a different method of return, which will not involve the Buyer having to bear additional costs.

  13. The Seller declares that the right of withdrawal does not apply to contracts included in art. 38 of the Act of May 30, 2014 - on consumer rights,

  14. By concluding the contract, the Consumer or the Entrepreneur on consumer rights confirms that he has read the content of these regulations, including that he has been notified of the right to withdraw from the concluded sales contract within 14 days from the date of delivery of the goods to him.

 

 

§8 Complaints

 

1. The basis and scope of the Seller's liability towards the Customer for non-compliance of the Product with the Agreement are defined by generally applicable laws and the following provisions of the Regulations.

2. The seller is obliged to deliver the product without defects.

3. In the event of any mechanical damage arising during delivery or in the event of a complaint being filed with the Seller, the Buyer should send information about this fact via e-mail: magdalena@drzewozycia.net. In the notification, it is recommended to indicate the defect that the customer believes the goods have, and if it is possible - document the defect in question, date of the defect, request for a method of bringing the goods into conformity with the contract in accordance with art. 560 et seq. Of the Civil Code and providing contact details. The above requirements are recommendations and their absence does not affect the effectiveness of the complaint.

4. The Seller will respond to the notification within 14 days of receiving the notification. Failure to respond to the Seller within the above-mentioned period means that the Seller considered the complaint justified.

5. Detailed information on the possibility for the Customer who is a Consumer to use extrajudicial means of dealing with complaints and redress and the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection. , Provincial Inspectorates of the Trade Inspection and at the following internet addresses of the Office of Competition and Consumer Protection:

6. The Customer who is a Consumer has in particular (but not exclusively) the following exemplary possibilities of using out-of-court complaint and redress procedures:

The customer is entitled to apply to a permanent amicable consumer court referred to in Art. 37 of the Act of December 15, 2000 on the Trade Inspection (consolidated text: Journal of Laws of 2019, item 1668, as amended), with a request to settle a dispute arising from the concluded Sales Agreement. The regulations of the organization and operation of permanent amicable consumer courts are specified in the ordinance of the Minister of Justice of 6 July 2017 on the rules of organization and operation of permanent arbitration courts of permanent arbitration at voivodship inspectors of trade inspection. (Journal of Laws of 2017, item 1356).

8. The customer is entitled to apply to the provincial inspector of Trade Inspection, in accordance with Art. 36 of the Act of December 15, 2000 on the Trade Inspection (consolidated text: Journal of Laws of 2019, item 1668, as amended), with a request for an out-of-court resolution of the dispute between the Customer and the Seller. Information on the rules and procedure of the mediation procedure conducted by the provincial inspector of the Trade Inspection is available at the premises and on the websites of individual Provincial Inspectorates of the Trade Inspection.

The ODR platform is also a source of information on the forms of out-of-court dispute resolution that may arise between entrepreneurs and Consumers.

 

 

§9 Rules for publishing opinions

1. Each buyer / customer may publish opinions about a good / service in the appropriate place on the Store's website. The opinion should be written in Polish, with the principles of a more correct Polish language.

2. Opinions are subjective statements of customers. The seller is not responsible for their content.

3. The Buyer / customer declares that his statement does not violate applicable law or the rights of third parties. He bears full responsibility for statements posted by him in the Online Store www.drzewozycia.net

4. The submitted opinion is verified by the seller in terms of checking whether the opinion does not contain prohibited content, i.e. in particular when the opinion violates applicable regulations, contains prohibited content, advertising, personal data, infringes copyrights, etc.

 

§ 10 Personal data

1. The administrator of personal data is the Seller.

2. The rules for the protection of personal data can be found in the Privacy Policy of the online store www.drzewozycia.net, available at https://www.drzewozycia.net/polityka.

 

 

§ 11 Final provisions

  1. The Seller reserves the right to amend these Regulations for important reasons. Any changes to the Regulations come into force on the appropriate date indicated by the Seller, but not shorter than 7 days.
  2. The amended Regulations bind the Buyer / Customer if the requirements specified in art. 384 and 384 [1] of the Civil Code, that is, he was properly informed about the changes and did not terminate the contract within 14 calendar days from the date of notification.

  3. Pursuant to Art. 8 sec. 3 point 2 lit. b of the Act of 18.7.2002 on the provision of electronic services, the entity using the website of the online store www.drzewozycia.net is obliged not to post illegal content on this website.

  4. In matters not covered by these regulations, the relevant provisions of the Civil Code and the Act of May 30, 2014 - on consumer rights will apply.

  5. These Regulations are available at the internet address www.drzewozycia / regulations.

  6. Agreements with the seller are concluded in Polish.

  7. The Regulations enter into force on August 16, 2022.
